{"id":12632,"date":"2026-02-06T14:52:35","date_gmt":"2026-02-06T14:52:35","guid":{"rendered":"https:\/\/elpregonerodechile.com\/?p=12632"},"modified":"2026-02-06T14:52:35","modified_gmt":"2026-02-06T14:52:35","slug":"former-australis-manager-claims-lawyer-vivanco-may-have-influenced-2022-ruling-favoring-salmon-company","status":"publish","type":"post","link":"https:\/\/elpregonerodechile.com\/?p=12632","title":{"rendered":"Former Australis Manager Claims Lawyer Vivanco May Have Influenced 2022 Ruling Favoring Salmon Company"},"content":{"rendered":"<p> \n<\/p>\n<div>\n<p data-parapraph=\"0\">Original article: <a href=\"https:\/\/www.elciudadano.com\/justicia\/exgerente-de-australis-acusa-que-vivanco-pudo-estar-tras-fallo-de-2022-favorable-a-la-salmonera\/02\/06\/\" target=\"_blank\">Exgerente de Australis acusa que Vivanco pudo estar tras fallo de 2022 favorable a la salmonera<\/a><\/p>\n<hr\/>\n<p id=\"h-\" data-parapraph=\"1\">A new accusation adds to the intricate legal challenges faced by former Supreme Court Minister \u00c1ngela <a href=\"https:\/\/www.elciudadano.com\/?s=Vivanco\" title=\"Vivanco\" class=\"search-link\">Vivanco<\/a>, who is currently under preventive detention for her alleged involvement in the so-called \u00abBielorrusa Scheme.\u00bb<\/p>\n<p data-parapraph=\"2\">Rub\u00e9n Henr\u00edquez, who served as legal manager for the salmon company Australis between 2013 and 2022, filed a formal complaint with the 7th Guarantee Court in Santiago linking the former magistrate to a potential corrupt scheme aimed at securing a favorable ruling for the company from the highest court.<\/p>\n<p data-parapraph=\"3\">The accusation, which was accessed by the digital media Reportea, raises suspicions about the \u201cshadow\u201d advisory provided by lawyer Alberto Eguiguren, who reportedly received over $200 million for services that, according to the former executive, included irregular and privileged access to the Third Chamber of the Supreme Court when the former judge\u2014currently implicated in bribery and money laundering\u2014was a member.<\/p>\n<h3 class=\"wp-block-heading\" id=\"h-nbsp-million-dollar-payments-from-australis-to-alberto-eguiguren\"><span id=\"million-dollar-payments-from-australis-to-alberto-eguiguren\">\u00a0Million-Dollar Payments from Australis to Alberto Eguiguren<\/span><\/h3>\n<p data-parapraph=\"4\">The heart of the accusation dates back to early 2022. The Third Chamber of the Supreme Court, composed at the time of ministers \u00c1ngela Vivanco, Mario Carroza, Adelita Ravanales, Juan Manuel Mu\u00f1oz, and Sergio Mu\u00f1oz, was deliberating the future of a key project for Australis: a salmon processing plant in Puerto Natales, Region of Magallanes, with a $100 million investment.<\/p>\n<p data-parapraph=\"5\">Although this project had received its Environmental Qualification Resolution (RCA), environmental organizations and local communities had filed cassation resources with the Supreme Court seeking to annul it.<\/p>\n<p data-parapraph=\"6\">According to Henr\u00edquez\u2019s account, it was against this backdrop that in December 2021, the company decided to hire the services of lawyer Alberto Eguiguren, recommended for his presumed effectiveness in obtaining favorable results in that very chamber of the country\u2019s highest court.<\/p>\n<p data-parapraph=\"7\">The engagement was formalized through a fee proposal sent by Eguiguren on December 10, 2021. In it, the lawyer stipulated a fixed cost of 1,500 UF and an additional payment of 5,500 UF if Australis won the case in the Supreme Court, totaling $216 million.<\/p>\n<p data-parapraph=\"8\">However, Henr\u00edquez made it clear that \u201cno lawyer from that firm, including Alberto Eguiguren, as noted in the Virtual Judicial Office, had power in the case nor participated in defining the strategy, drafting documents such as reports or writings, or represented Australis before the Supreme Court.\u201d<\/p>\n<p data-parapraph=\"9\">The formal legal representation belonged to the firm Vergara, Galindo and Correa. According to the complainant, Eguiguren\u2019s role was different.<\/p>\n<p data-parapraph=\"10\">The legal action includes a series of emails where Eguiguren requests minutes and reports from the sponsoring firm. The goal, as explained to sponsoring lawyer Jos\u00e9 Luis Fuenzalida, was \u201cto have summarized information to present the case directly to one or more ministers of the Excellent Supreme Court\u2019s Third Chamber.\u201d<\/p>\n<p data-parapraph=\"11\">According to Henr\u00edquez, Eguiguren dismissed contacting Minister Sergio Mu\u00f1oz, \u201cwhom he said he did not hold in good regard,\u201d and Minister Adelita Ravanales, \u201cwhom he claimed could not be contacted outside of hearings.\u201d<\/p>\n<h3 class=\"wp-block-heading\" id=\"h-voting-in-the-supreme-court-favorable-to-the-salmon-company\"><span id=\"supreme-court-vote-favorable-to-the-salmon-company\">Supreme Court Vote Favorable to the Salmon Company<\/span><\/h3>\n<p data-parapraph=\"12\">The accusation stated that on February 10, 2022, the Third Chamber internally voted on the cassation resources. The result, which would remain under absolute confidentiality for six months, was 4 votes in favor of dismissing the requests (Vivanco, Carroza, Ravanales, Juan Manuel Mu\u00f1oz) and 1 against, by Sergio Mu\u00f1oz.<\/p>\n<p data-parapraph=\"13\">According to Henr\u00edquez, Eguiguren informed Australis executives of the voting outcome that same day.<\/p>\n<p data-parapraph=\"14\">\u201cThat same day, and to our great surprise, Alberto Eguiguren informed Ricardo Misraji, Jos\u00e9 Luis Fuenzalida, and me via a WhatsApp phone call that Australis had won the case with the only dissenting vote from Minister Sergio Mu\u00f1oz,\u201d detailed the complaint, obtained by Reportea.<\/p>\n<p data-parapraph=\"15\">As evidence, Henr\u00edquez attached a screenshot of a WhatsApp message sent to his wife on that February 10: \u201c4-1\u2026 SM [Sergio Mu\u00f1oz],\u201d he wrote.<\/p>\n<p data-parapraph=\"16\">Six months later, on August 22, 2022, the ruling became public, and Australis proceeded to pay the fee of 5,500 UF to the firm Russi &amp; Eguiguren Spa, of which Eguiguren is a partner.<\/p>\n<p data-parapraph=\"17\">The purchase order, dated August 26, specified the description as \u201cStrategic Advisory Supreme Court Case Dumestre.\u201d<\/p>\n<p data-parapraph=\"18\">Furthermore, the complaint includes an email from then-General Manager of Australis, Andr\u00e9s Lyon, dated August 24, 2022, discussing the payment: \u201cNow I understand why they wanted to celebrate, and why AE couldn\u2019t\u2026\u201d an allusion that, for Henr\u00edquez\u2019s circle, suggests that Eguiguren could not celebrate beforehand because he had prior irregular knowledge of the ruling.<\/p>\n<p data-parapraph=\"19\">Reportea\u2019s investigation reveals that suspicions regarding Eguiguren\u2019s role are not new, as in March 2025, the media outlet El Mostrador had already reported, based on three sources linked to Australis, that the lawyer had communicated the outcome the same day of the voting in the Supreme Court.<\/p>\n<p data-parapraph=\"20\">Additionally, subsequent reports detailed how Eguiguren had achieved a prior success in the Third Chamber in September 2021, reversing a previous denial of a real estate project in Valpara\u00edso, where \u00c1ngela Vivanco\u2019s vote was also pivotal. This background was likely the key reason Australis hired him.<\/p>\n<h3 class=\"wp-block-heading\" id=\"h-eguiguren-and-australis-deny-wrongdoing\"><span id=\"eguiguren-and-australis-deny-wrongdoing\">Eguiguren and Australis Deny Wrongdoing<\/span><\/h3>\n<p data-parapraph=\"21\">Alberto Eguiguren denied all allegations in a written response to <a href=\"https:\/\/reportea.cl\/2026\/02\/04\/la-guerra-de-australis-salpica-a-vivanco-exgerente-de-la-salmonera-denuncia-acceso-irregular-de-alberto-eguiguren-a-la-suprema\/\" target=\"_blank\" rel=\"noreferrer noopener\">Reportea<\/a>. He described Henr\u00edquez\u2019s allegation as \u201can invented infamy\u201d and part of a maneuver amid the legal battle between the former and current owners of Australis.<\/p>\n<p data-parapraph=\"22\">\u201cThis insinuation is an invented infamy by lawyer Rub\u00e9n Henr\u00edquez (former prosecutor of Australis) and the close circle of Isidoro Quiroga, including his lawyers,\u201d he said.<\/p>\n<p data-parapraph=\"23\">He indicated that the \u201cmaneuver\u201d aims to tarnish Australis and its advisors, \u201cto try to overcome the complex judicial situation that Mr. Henr\u00edquez and the Quiroga family are currently facing.\u201d<\/p>\n<p data-parapraph=\"24\">\u201cQuiroga lost an arbitration case in which he was ordered to pay over $300 million, is formally accused of fraud and disloyal administration, is being investigated for money laundering, and recently in January of this year, Australis sued him, his children, and his close circle \u2013 including lawyer Henr\u00edquez \u2013 for over $440 million,\u201d he asserted.<\/p>\n<p data-parapraph=\"25\">Regarding his relationship with Vivanco, he stated: \u201cShe taught me classes over 40 years ago in college, but outside of that, I have no relationship or closeness with her. I have never known or had any contact with any past or current minister of the Third Chamber of the Supreme Court.\u201d<\/p>\n<p data-parapraph=\"26\">\u201cAny other insinuation is a complete lie,\u201d he emphasized.<\/p>\n<p data-parapraph=\"27\">For its part, Australis also issued a statement, explaining that it hired Russi &amp; Eguiguren in December 2021 \u201cas an advisor and coordinator\u201d for a series of judicial proceedings, a role similar to what he would currently perform in defending the company against its former owner, Isidoro Quiroga. They denied any wrongdoing.<\/p>\n<p data-parapraph=\"28\">Henr\u00edquez\u2019s complaint, filed on February 3, 2026, seeks to have these findings included in the investigation of the \u201cBielorrusa scheme\u201d currently being processed by the Regional Prosecutor\u2019s Office of Los Lagos.
