autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/p>\n<\/figure>\n<p data-parapraph=\"3\">The conflict arose during a raid conducted on August 13 in the Mapuche community of Chequenco, Ercilla, where, despite having judicial authorization, the operation was executed violently in the presence of children, severely violating their rights.<\/p>\n<p data-parapraph=\"4\">The National Institute of Human Rights (INDH) in La Araucan\u00eda filed the legal action on behalf of a 9-year-old boy and a 3-year-old girl, whose homes were subjected to disproportionate intrusion.<\/p>\n<h3 class=\"wp-block-heading\" id=\"h-fundamentos-de-la-corte-y-una-orden-clave\"><span id=\"courts-rationale-and-a-key-order\"><strong>Court\u2019s Rationale and a Key Order<\/strong><\/span><\/h3>\n<p data-parapraph=\"5\"><strong>The Temuco Court, in its Rol N\u00b0356-2025 ruling<\/strong>, acknowledged that while the operation had judicial approval from the Collipulli Court of Letters and Guarantees, its execution was excessive.<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u00a0See\u00a0<a href=\"https:\/\/www.diarioconstitucional.cl\/wp-content\/uploads\/2025\/10\/sentencia-Corte-de-Temuco-Rol-N%C2%B0356-2025.pdf\">Temuco Court ruling Rol N\u00b0356-2025<\/a>.<\/strong><\/p>\n<\/blockquote>\n<p data-parapraph=\"6\">The court was firm in stating that the police action \u00abwas carried out disproportionately and violated the rights of young children, noting that the fact these minors lived in the premises could only have been known by the police agents.\u00bb It added that the operation, conducted around 4:00 AM and involving the use of force, \u00abcould only cause psychological distress and disruption to the mentioned children, given their young age and physical stature.\u00bb<\/p>\n<p data-parapraph=\"7\">The ruling stressed the \u00abunconditional duty of state agents to respect, guarantee, and promote children\u2019s rights, as they belong to a group requiring special protection, particularly because they come from an indigenous community.\u00bb Consequently, the Court upheld the amparo and ordered the PDI to \u00abtake utmost precautions in future operations, especially in contexts where children, adolescents, and individuals from indigenous communities are present, adopting operational protocols that comply with national and international human rights standards.\u00bb<\/p>\n<h3 class=\"wp-block-heading\" id=\"h-contexto-y-reaccion-del-indh\"><span id=\"context-and-indh-reaction\"><strong>Context and INDH Reaction<\/strong><\/span><\/h3>\n<p data-parapraph=\"8\"><a href=\"https:\/\/www.indh.cl\/corte-temuco-amparo-ninos-y-ninas-pdi\/\">The INDH announced the resolution at the end of September<\/a>, noting that this is the third amparo action filed by its La Araucan\u00eda office against PDI operations that has been accepted by the courts: \u00abThis year, the La Araucan\u00eda office of the INDH has filed three amparo actions due to PDI operations.
