Senate Strengthens Penalties for Trafficking Highly Toxic and Addictive Drugs El Ciudadano

The Senate has approved the two amendments made by the Chamber of Deputies to the bill aimed at toughening penalties against the illicit trafficking of substances or drugs that, even in small amounts, can cause serious toxic effects or considerable harm to health.

As a result, the initiative — which amends Law 20,000 — is now ready to be enacted as a Law of the Republic.

According to the Senate bulletin, during the voting, there were proposals to refer the bill to a mixed commission to clarify whether the responsibility lay with the Ministry of the Interior or the Ministry of Public Security on this matter.

This was raised because in the Chamber, the former Ministry of Interior and Public Security was replaced by the Ministry of Public Security, which some argued was inappropriate since Senda (National Service for the Prevention and Rehabilitation of Drug and Alcohol Consumption) falls under the Interior department.

Ultimately, in a divided vote, senators decided to maintain the change made by the deputies. Additionally, they approved a second amendment from the deputies that removed the explicit listing of highly toxic substances such as fentanyl, carfentanil, ketamine, and methamphetamine, leaving it subject to regulation, as it was deemed that including it in the law would make it overly rigid.
